הכבאים ממחוז צפון שלא יצאו לאימוני ״צוות באוויר״ בשנת 2019 יקבלו את שכרם. בית המשפט: ניסיון ההנהלה לשכנע את העובדים שהשביתה אינה כדאית הופך את החלטתה לבלתי לגיטימית

בית הדין האזורי לעבודה בנצרת, בראשותה של כבוד השופטת יעקבס אורית, פסק היום כי הכבאים שלא נטלו חלק באימוני ״צוות באוויר״ שהתקיימו במחוז צפון במהלך החודשים מרץ ואפריל 2019 יקבלו את שכרם. מדובר על תקופה שהיתה תחת ההנהלה הקודמת ואינה קשורה כלל להנהלה הנוכחית.

אימוני ״צוות באוויר״ הם אימונים שבהם צוותי הכיבוי היו יוצאים מהמשמרת לטובת האימון וחוזרים לאחריו להמשך המשמרת, מה שגרם לעייפות ועומס רב בקרב הכבאים.

כתוצאה מכך פנה ארגון העובדים להנהלה וסיכם על מתווה שקבע כי האימון יקוצר וייארך עד לשעה 14:00 בלבד במקום 16:00, עניין שיפחית מהעומס על הכבאים.

לאחר שההסכם לא כובד על ידי ההנהלה והאימונים לא קוצרו, הנחה ארגון העובדים את הכבאים שלא לצאת לאימוני ״צוות באוויר״ ולהישאר כרגיל בתחנות.

ואכן, הכבאים נשמעו להנחיות הארגון וההסתדרות ולא יצאו לאימונים. בעקבות זאת ביקשו המת״חים במחוז מהכבאים לעזוב את התחנות. הכבאים סירבו ובהוראת ארגון העובדים הם נותרו במשמרת. כתוצאה מכך הנחה המחוז הצפוני את חשבי השכר שלא לשלם שכר לאותם כבאים עבור אותו יום במשמרת.

כך כתבה כבוד השופטת יעקבס: ״ומן הכלל אל הפרט - לאחר שמיעת העדויות ובחינת הראיות שהונחו לפנינו הגענו לכלל מסקנה כי השיקולים שעמדו בבסיס החלטת הנתבעת לסרב לקבל עבודה חלקית, היו לכל הפחות מעורבים, כך שהנתבעת בחרה בדרך של סירוב לקבל עבודה חלקית לא רק עקב רצונה לצמצם את נזקי העיצומים אלא גם בשל ניסיונה לשכנע את העובדים המאורגנים שהשביתה אינה כדאית, מה שמכתים את החלטתה והופך אותה לבלתי לגיטימית״.

השופטת הורתה להנהלת הכבאות לשלם לעובדים את השכר הראוי.
