כבאי מתחנת עפולה נשפט בגין דיווח מחלה כוזב, בית המשפט לב"כ המדינה: "לא חושב שכדאי לכם שאתן פס"ד, לכו לפשרה".

בדיון שהתקיים היום בבית הדין האזורי לעבודה בנצרת נידונה תביעתו של הכבאי ש' אשר הואשם על ידי מפקד התחנה לשעבר, טפסר משנה עופר אדרי, כי דיווח בצורה כוזבת על מחלה.

ב5.7.2020 ילדה אישתו של ש' בת. ש' הגיש אישור מחלה שלא היה לשביעות רצון מפקד המשמרת ומפקד התחנה. השניים דרשו ממנו אישור מחלה על שם האישה. משלא המציא אישור שכזה הועמד ש' לדיון משמעתי באשמה של דיווח כוזב, לא פחות. מפקד התחנה אדרי גזר עליו קנס של שלושה ימים ואילו את שלוש המשמרות שבהן היה בחופש החשיב כימי היעדרות ללא שכר, כך שבפועל נוכו ממשכורתו של ש' 12 ימים בסך הכל, ששוויים הכספי הוא 5,173 שקלים!
כבר בתחילת הדיון פנה הרשם אביעד תורג'מן אל ב"כ המדינה, המתמחה גב' סוהא דלה, ושאל אותה האם מוסכם שהתובע רשאי היה להיעדר בתקופה שנעדר? ב"כ המדינה השיבה שכן.
הרשם פנה מספר פעמים במהלך הדיון אל ב"כ המדינה, חזר ושאל, כיצד הפך עניין כזה להליך משמעתי, וגם אם נפתח הליך שכזה, מדוע נבחרה הסנקציה החמורה ביותר?

לאחר מספר דקות הציע הרשם לצדדים לנסות להגיע לפשרה מחוץ לאולם. המדינה הציעה לש' החזר שכר מלא עבור כל 12 הימים אך מבלי שההליך המשמעתי יתבטל אלא יישאר בתיקו האישי. ההצעה נדחתה על הסף הן בידי ש', הן בידי בא כוחו מטעם ההסתדרות, עו"ד פיראס סעדי, והן בידי חבר המזכירות ונציג הארגון במחוז צפון כפרי אזולאי.

כאשר חזרו הצדדים אל אולם בית המשפט בלא להסכמה הבהיר הרשם לבא כח המדינה כי כדאי לה שלא לקבל פסק דין בתיק. הרשם הפנה את הצדדים להידברות ישירה והתייעצות לצורך יישוב המחלוקת בתוך 30 יום.

מארגון העובדים נמסר הערב כי זהו עוד הליך שהחל בתקופה הרעה שכבר עברה לה מעולמנו. אפשר רק להצטער על פגיעה בעובדים וזו אחת מיני רבות. בוזבזו כספים ומשאבים רבים של המדינה לחינם ממש. כל עובד יקבל גיבוי הן מארגון העובדים והן מההסתדרות ככל שיידרש.
